Government, Tata Chemicals Magadi Form Technical Committee to Resolve Mining Disputes

The Government and Tata Chemicals Magadi Limited have agreed to form a high-level technical committee to address outstanding compliance issues following the suspension of operations at the mining company.

The agreement was reached during a meeting between Cabinet Secretary for Mining, Blue Economy and Maritime Affairs Hassan Ali Joho and executives of Tata Chemicals Magadi Limited on Tuesday.

The meeting focused on resolving compliance concerns raised by the Ministry and establishing a framework for addressing the outstanding matters between the Government, the company and other affected stakeholders.

According to Joho, the technical committee will be jointly led by the Principal Secretary for Mining on behalf of the Ministry and the Chief Executive Officer of Tata Chemicals Magadi Limited on behalf of the company.

The committee will conduct a detailed technical review of the unresolved issues and prepare a report for submission to the Cabinet Secretary for consideration and further direction.

Among the issues set to be reviewed are mineral beneficiation and in-country value addition, outstanding community benefits and royalty obligations, unresolved land matters, opening up the area for multiple mineral extraction, and outstanding issues with the Kajiado County Government.

Joho said the engagement was aimed at finding a comprehensive and timely solution to the concerns raised by the Ministry.

“As Government, we remain committed to constructive engagement with investors while firmly upholding Kenya’s laws, regulations and the interests of its people,” Joho said.

The Cabinet Secretary said resolving the outstanding compliance matters would also help establish a sustainable framework for responsible mining, value addition and community development.

He said the Government remained committed to working constructively with investors while ensuring that mining activities complied with Kenya's laws and regulatory requirements.

The formation of the committee followed the suspension of operations at Tata Chemicals Magadi Limited, which prompted the Ministry to raise a number of compliance concerns.

The technical review will provide a platform for the Government and the company to examine the outstanding matters and present recommendations aimed at resolving the dispute.

The Government said its objective was not only to address the immediate compliance concerns but also to promote responsible mining, value addition, community development and mutually beneficial partnerships.
